Can be located in rear or side yards. Detached, semi-detached and townhouses may have Garden Suites.
Setbacks
Location dependent:
Brampton - 6ft from side fence, 8.25' from rear fence, min 10ft from principal dwelling
Caledon/Bolton - 4ft from side fence, 2ft from rear fence
Mississauga - 2ft from side fence (6ft for two-story), 6ft from rear fence
Access
Must allow for a 4ft unobstructed pathway to the Garden Suite. One parking spot must be allocated if there is already an existing ARU (ex: basement suite)
Size
Max square footage depends on location. Ex: in Brampton you can build up to 376sqft but also have a basement to double the area. Caledon allows up to 807sqft. Mississauga up to 600sqft and two-story.
Height
Brampton/Caledon - The lesser of the height of the principal dwelling or 25ft Hamlet, Estate or Agricultural Zones and 15ft Residential Zones.
Mississauga - 10ft excluding roof pitch, 19ft for two-story
Other
- No rooftop patios/decks or balconies
- Basements are allowed
- Mechanical rooms do not count towards max square footage
